TERMS AND CONDITIONS OF SALE
ARTICLE 1: SCOPE OF APPLICATION
The general conditions of sale detailed below (hereinafter referred to as the “General Conditions”) govern the contractual relationship between any Customer and Cardiofirstangel.fr, Marque de Management y Analisis de Compras, a limited company with its registered office at Calle Elisenda 24 – 08172 Sant Cugat del Valles (Barcelona- Spain) and registered in Barcelona under number B61491908 (hereinafter referred to as “MAC”).
These terms and conditions of sale are the only ones applicable and supersede all other conditions, unless expressly waived in advance in writing. Cardiofirstangel.fr may from time to time modify certain provisions of its terms and conditions.
By validating an order, each customer accepts without reservation our general terms and conditions of sale after having read them.
Cardiofirstangel.fr – Management y Analisis de Compras will not accept any clause accompanying a customer order that conflicts with or adds a new element to these General Conditions.
ARTICLE 2: PRICE LIST
The products sold by cardiofirstangel.fr are invoiced in euros all taxes included at the price of the tariff in force at the day of the recording of the order by cardiofirstangel.fr. Cardiofirstangel.fr reserves the right to change its prices at any time in accordance with current practice and regulations.
ARTICLE 3: TERMS OF PAYMENT
Unless special conditions require the intervention of Customer Service, payments are made online
by credit card or Paypal.
As soon as you click on the “Pay by credit card” button, you will automatically be directed to the secure payment center we work with.
By clicking on the “Paypal” button, you will automatically receive the information and forms required to pay for your order.
Upon confirmation of your payment, we will process your order.
ARTICLE 4: LATE PAYMENT PENALTIES
In application of the laws and regulations in force, any sum paid after its due date, whatever the reason and whatever the agreed method of payment, will give rise to the payment of a late payment penalty applicable from this due date, the amount of which will be calculated on the basis of one and a half times (1.5 times) the bank prime rate, as well as an indemnity for collection costs of €40 per invoice paid late. Upon presentation of proof, the amount of late penalties may be increased if collection costs exceed the amount of this fixed indemnity.
In all cases, this late payment penalty may not be less than 5% and may not exceed 40% of the amount of the sums due.
ARTICLE 5: PRODUCT AVAILABILITY
Our products are available while stocks last. Cardiofirstangel.fr has a permanent stock of Cardio First Angel. In the event of product unavailability, customers are alerted online as soon as the order is placed, by a message indicating the delivery date. In the event of a delay of more than 30 working days, Cardiofirstangel.fr will inform customers who have placed an order by e-mail, offering to cancel the order.
ARTICLE 6: SHIPPING – DELIVERY – DELIVERY CHARGES
Cardiofirstangel.fr chooses the delivery service provider.
Metropolitan France and Iberian Peninsula: shipping costs included.
Rest of Europe: a flat-rate charge of €8 for shipping.
For non-EU countries :
You may be required to pay customs and import duties on your package depending on the country of delivery. If your parcel is subject to this, the person receiving the parcel is obliged to cover these costs.
Cardiofirstangel.fr endeavours to deliver to mainland France within 5 working days of payment of the order. Delivery times to Corsica and French overseas departments and territories are subject to special shipping conditions.
Upon receipt, the customer must check that the packages are in good condition and make any necessary reservations with the carrier within the legal time limit. Please note that the words “subject to inspection” or “subject to unpacking” have no legal value with carriers or insurers. The customer is obliged to provide proof of any shortage or breakage.
Cardiofirstangel.fr will endeavour to meet the delivery times stipulated in the order, but rejects any claim for damages for delays of less than 15 days in deliveries and therefore does not accept any cancellation of orders.
ARTICLE 7: COMPLAINTS
If the products received do not conform to the invoice, the Customer must notify cardiofirstangel.fr Customer Support immediately, or at the latest within three days of receipt of the order. Upon receipt, the Customer must ensure that the packages are in good condition and make the usual reservations with the carrier within the legal time limit specified on the Delivery Note.
ARTICLE 8: RETURNS
There is no withdrawal period for orders placed over the Internet.
Products may only be returned with the prior written agreement of the Cardiofirstangel.fr team, within a maximum of 30 days of delivery.
The products must then be returned to cardiofirstangel.fr carriage paid to the address indicated on the form available on the cardiofirstangel.fr website with an advisor or by e-mail to philippe.rudowski@inotech.de, within a maximum of 7 days following notification of the agreement by Customer Service -cardiofirstangel.fr.
Returned products must be in perfect condition, and carefully packaged in their original packaging, without any modification of their references or serial numbers; they must keep their label intact, as well as any stamps or marks allowing the resale of these products.
Subject to the above, cardiofirstangel.fr will reimburse by bank transfer the price of the returned product(s) and the invoiced shipping costs up to the amount corresponding to the least expensive standard shipping method, if they have already been paid, within 14 days of the date of receipt by cardiofirstangel.fr. The cost of return shipment will be borne by the Customer.
ARTICLE 9: WARRANTIES AND CUSTOMER SUPPORT
CARDIO FIRST ANGEL:
The Cardio First Angel is guaranteed for 2 years by the manufacturer in accordance with the General Warranty Conditions downloadable from the website www.cardiofirstangel.fr website, without prejudice to the legal warranty against hidden defects as provided for in articles 1641 to 1649 of the French Civil Code, which stipulate in particular that “the seller is liable for any hidden defects in the item sold which render it unfit for its intended use, or which impair this use to such an extent that the buyer would not have purchased it, or would only have paid a lower price for it, had he or she been aware of them”, and for the legal warranty of conformity as provided for in articles L.211-4, L.211-5 and L.211-12 of the French Consumer Code, which stipulate that “the seller is obliged to deliver goods in conformity with the contract, and is responsible for any defects in conformity existing at the time of delivery. To be in conformity with the contract, the good must be fit for the use usually expected of a similar good. Any action resulting from a lack of conformity is barred after two years from delivery of the goods”.

If the Customer is authorized to return his Cardio First Angel under the warranty, cardiofirstangel.fr undertakes to replace it free of charge with an equivalent product as soon as possible in Metropolitan France.
The carrier delivering the product will collect the old equipment and place it directly into the packaging of the new Cardio First Angel. He will affix the pre-printed forwarding label to the carton. The customer will then sign the exchange report to be inserted inside the packaging. The delivery driver can then take charge of the shipment…
ARTICLE 10: LIMITATION OF LIABILITY
No liability will be accepted for loss or damage, direct or indirect, howsoever caused.
Under no circumstances shall the customer be entitled, on any grounds whatsoever, to make any deduction from the amount of invoices corresponding to incomplete deliveries or defective products.
ARTICLE 11: RETENTION OF TITLE
Cardiofirstangel.fr keeps the property of the delivered goods until the complete payment of the price in principal and accessories.
Cardiofirstangel.fr reserves the right to suspend any delivery or service of any nature whatsoever in the event of late payment, until the debtor’s account has been settled in full.
The customer must immediately inform cardiofirstangel.fr of any seizure of materials delivered under reservation of title.
ARTICLE 12: SALE CANCELLATION CLAUSE
In the event of special provisions agreed at the time of order and non-payment of a delivery on its due date, the sale will be cancelled by operation of law eight days after formal notice served by registered letter with acknowledgement of receipt has remained without effect. Cardiofirstangel.fr will then reclaim the goods in question, which must be returned to it or their equivalent, without delay, at the Customer’s expense and risk, all without prejudice to any damages.
ARTICLE 13: FORFEITURE OF TERM
In the case of special provisions agreed at the time of order, failure to pay a sum by the agreed due date will result in the immediate payment of all sums owed by the Customer and not yet due.
ARTICLE 14: APPLICABLE LAW – JURISDICTION
In the event of a dispute relating to the execution of an order and/or the interpretation of these terms and conditions, an amicable solution will be sought before any legal recourse. The prior search for an amicable solution does not interrupt the time limits for bringing an action under warranty.
In the event of failure to reach an amicable settlement, all disputes that may arise between cardiofirstangel.fr and its Customers will be under the exclusive jurisdiction of the Commercial Court of Barcelona and Spanish law will be applicable.
